By downloading, installing, or using the Pop or Keep mobile application (the "App"), you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old to use Pop or Keep. We verify age via a declared date of birth at signup. Submitting a false date of birth is a material breach of these Terms and grounds for permanent suspension.
You must not be listed on any U.S. government restricted-party list, and you must not have been previously removed from Pop or Keep for a policy violation.
2. Your account
Pop or Keep accounts are tied to an email address you control. You are responsible for keeping your email, passwords, and devices secure. Do not let anyone else use your account. You agree to provide truthful information: your real first name, a recent photo of you, your actual date of birth. Impersonation is prohibited.
You may delete your account at any time from Me → Delete account. On deletion we wipe your personally identifying information immediately; we retain your email address on a tombstone record for up to 30 days to prevent abuse-based re-signup, after which the row is hard-deleted.
3. Content
"Your Content" means anything you submit: photos, bio text, messages. You retain ownership. You grant Pop or Keep a worldwide, royalty-free license to host, display, and transmit Your Content only for the purpose of operating the App and related safety systems (moderation, abuse detection, legal compliance). This license ends when you delete the content or your account, except where we are legally required to retain it (e.g., NCMEC reporting under 18 U.S.C. § 2258A).
4. Prohibited conduct
You may not:
- Upload nudity, sexually explicit imagery, or content depicting minors in any context.
- Harass, threaten, stalk, defame, or defraud another user.
- Post solicitations for sex work, drugs, weapons, or other illegal goods.
- Use the App for commercial promotion, investment pitches, or network marketing.
- Use automated means (bots, scripts, scrapers) to interact with the App.
- Attempt to circumvent moderation, reports, blocks, suspensions, or rate limits.
- Collect or store another user's data outside of normal App use.
5. Safety tools
Pop / Keep / Match
You can Pop (remove) or Keep (express interest) in any profile. A match happens only when both users Keep each other.
Reports
You can report any user from their chat header. We auto-suspend an account once it receives reports from three distinct users within a rolling 30-day window; underage reports suspend on first receipt.
Blocks
You can block any user. Blocks are mutual and permanent unless you unblock; blocked users cannot see your profile and you cannot see theirs.
CSAM
Any image matched by our hash-based CSAM detection is escalated to the National Center for Missing & Exploited Children under U.S. law; the associated account is permanently disabled and relevant bytes are preserved.
6. Intellectual property
The Pop or Keep name, logo, visual identity, and app design are our property. You may not use them commercially without written permission.
7. Disclaimers
BALLOON IS PROVIDED "AS IS". WE DO NOT GUARANTEE COMPATIBILITY, UPTIME, OR THAT YOU WILL MEET ANYONE. DATING AND MEETING STRANGERS INVOLVES RISK. YOU ARE RESPONSIBLE FOR YOUR OWN SAFETY. MEET IN PUBLIC, TELL A FRIEND, TRUST YOUR INSTINCTS.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALLOON'S TOTAL LIABILITY TO YOU IS LIMITED TO THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9. Dispute resolution
Disputes are governed by the laws of the State of Delaware. You and Pop or Keep agree to resolve disputes via binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except small-claims matters, which can be brought in your local court. You waive the right to participate in class actions.
10. Changes
We may update these Terms. Material changes will be announced in-app with at least 14 days' notice; continued use after the effective date constitutes acceptance.
